Cancellation and Refund Conditions

CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND REFUND CONDITIONS


GENERAL:

  1. If you place an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance sales contract presented to you.

  2. Buyers are subject to the provisions of the Law on Consumer Protection numbered 6502 and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they purchase.

  3. Shipping costs, which are product shipment expenses, will be paid by the buyers.

  4. Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, Buyers may terminate the contract.

  5. The purchased product must be delivered complete and in accordance with the specifications stated in the order, and with warranty certificates and user manuals, if any.

  6. If the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days of learning of this situation. The total amount must be refunded to the Buyer within 14 days.


IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

  1. If the Buyer does not pay the price of the purchased product or cancels it in the bank records, the Seller's obligation to deliver the product ends.


PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

  1. If, after the product is delivered, it is determined that the credit card used by the buyer for payment has been unfairly used by unauthorized persons, and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the contract to the SELLER within 3 days, with the shipping costs borne by the SELLER.


IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

  1. If unforeseen circumstances beyond the Seller's control occur and the product cannot be delivered on time, the Buyer is notified. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order; if the payment was made in cash, this amount is paid back in cash within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels, the product price is refunded to the bank within 14 days from this cancellation, however, it is possible for the bank to transfer it to the buyer's account within 2-3 weeks.


BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  1. The Buyer shall inspect the goods/services subject to the contract before receiving them; will not accept damaged or defective goods/services such as dents, breaks, torn packaging, etc. from the shipping company. Goods/services received will be deemed to be undamaged and sound. The BUYER is obliged to carefully protect the goods/services after delivery. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned with the product.


RIGHT OF WITHDRAWAL:

  1. The BUYER may exercise the right to withdraw from the contract by rejecting the goods without undertaking any legal or penal responsibility and without stating any reason, provided that the BUYER notifies the SELLER through the contact information below within 14 (fourteen) days from the date of delivery of the purchased product to themselves or to the person/organization at the address indicated by them.

DURATION OF THE RIGHT OF WITHDRAWAL:

  1. If the purchased item is a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the performance of the service has started with the consumer's consent before the right of withdrawal period expires.

  2. The costs arising from the exercise of the right of withdrawal belong to the SELLER.

  3. To exercise the right of withdrawal, written notification must be made to the SELLER by registered mail with return receipt, fax or e-mail within 14 (fourteen) days, and the product must not have been used within the framework of the "Products for which the Right of Withdrawal Cannot Be Used" provisions regulated in this contract.


EXERCISE OF THE RIGHT OF WITHDRAWAL: 

  1. The invoice for the product delivered to the 3rd party or the BUYER, (If the invoice of the product to be returned is corporate, it must be sent with the return invoice issued by the company. Order returns issued for companies whose invoices are not accompanied by a RETURN INVOICE cannot be completed.)

  2. The return form, the box, packaging, and standard accessories, if any, of the products to be returned must be delivered complete and undamaged.


RETURN CONDITIONS:

  1. The SELLER is obliged to refund the total amount and the documents that put the BUYER into debt to the BUYER within a maximum of 10 days from the receipt of the withdrawal notification and to take back the goods within 20 days.

  2. If there is a decrease in the value of the goods due to the fault of the BUYER or if the return becomes impossible, the BUYER is obliged to compensate the SELLER's damages in proportion to his fault. However, the BUYER is not responsible for changes and deterioration caused by the proper use of the goods or product within the period of the right of withdrawal. 

  3. If the campaign limit amount set by the SELLER falls below due to the exercise of the right of withdrawal, the discount amount benefited from within the scope of the campaign is canceled.


PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

  1. Products prepared in line with the BUYER's wishes or explicit personal needs and not suitable for return, such as lower parts of underwear, swimwear and bikini bottoms, make-up materials, disposable products, goods that are in danger of rapid spoilage or that may expire, products that are not suitable for return for health and hygiene reasons if their packaging is opened by the BUYER after delivery, products that are mixed with other products after delivery and cannot be separated by nature, goods related to periodicals such as newspapers and magazines, except those provided under a subscription contract, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, and the return of audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, if their packaging has been opened by the BUYER, is not possible according to the Regulation. In addition, the exercise of the right of withdrawal regarding services whose performance has started with the consumer's consent before the right of withdrawal period expires is also not possible according to the Regulation.

  2. For cosmetic and personal care products, underwear products, swimsuits, bikinis, books, copyable software and programs, DVD, VCD, CD and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) to be returnable, their packaging must be unopened, untried, undamaged, and unused.


DEFAULT AND LEGAL CONSEQUENCES

  1. If the BUYER defaults in cases where payment transactions are made with a credit card, the BUYER accepts, declares, and undertakes to pay interest and be liable to the bank within the framework of the credit card agreement between the cardholder bank and the BUYER. In this case, the relevant bank may resort to legal remedies; it may demand the resulting expenses and attorney's fees from the BUYER, and in any case, if the BUYER defaults due to their debt, the BUYER accepts to pay the damages and losses incurred by the SELLER due to the delayed performance of the debt.
